This page sets out the product disclaimers and warranty limitations applicable to all products sold by Boxkart through our website at boxkart.shop. By purchasing from Boxkart, you acknowledge that you have read, understood, and agreed to the disclaimers and limitations set out herein. These disclaimers form part of our Terms and Conditions.

Important: Boxkart is a reseller of food packaging materials manufactured by third-party suppliers. We do not manufacture any products ourselves. All product information, specifications, and claims are based on information provided to us by our suppliers and are subject to the limitations described in this document.

1. General Product Disclaimer

All products sold by Boxkart are intended solely for their stated purpose as food packaging materials. Boxkart makes no representations or warranties, express or implied, beyond those explicitly stated on the relevant product listing page. In particular, Boxkart does not warrant that:

  • Products will be suitable for any specific use case not explicitly described in the product listing;
  • Product dimensions, weights, or capacities will be exact — minor manufacturing tolerances of up to ±3% are standard and acceptable;
  • Colours, finishes, or appearances will exactly match images displayed on the website, as screen calibration and batch variations may cause minor differences;
  • Products will meet regulatory requirements in jurisdictions outside India unless explicitly stated.

2. Third-Party Manufacturing Disclaimer

Boxkart sources its products from third-party manufacturers and suppliers. We do not manufacture any products in-house. As a result:

2.1 Manufacturing Defects

While we take reasonable steps to ensure product quality through supplier vetting and quality checks, Boxkart cannot guarantee that all products will be entirely free from manufacturing defects. Our liability in respect of manufacturing defects is strictly limited to the remedies set out in our Refund Policy, subject to the mandatory unboxing video requirement and the 48-hour claim window.

2.2 Supplier Changes

Boxkart reserves the right to change suppliers or manufacturers at any time without notice. Product specifications, materials, or appearances may vary slightly between batches as a result of supplier changes. Such variations do not constitute a defect or grounds for a refund unless they materially affect the product's intended function.

2.3 Limitation of Liability for Manufacturing Defects

Boxkart's maximum liability for any manufacturing defect shall not exceed the purchase price of the specific defective product(s), excluding shipping charges and GST. Boxkart shall not be liable for any indirect, consequential, incidental, or punitive damages arising from manufacturing defects, including but not limited to loss of business, loss of revenue, or damage to third-party property.

Note: If you are purchasing products for use in a regulated food service environment, you are solely responsible for verifying that the products meet all applicable local, state, and national food safety regulations before use. Boxkart does not provide regulatory compliance advice.

3. Food-Grade & Food Safety Disclaimer

3.1 Food-Grade Standards

Products listed as “food-grade” on our website are manufactured to be safe for direct or indirect contact with food under normal conditions of use, based on information provided by our suppliers. However:

  • Food-grade certification standards vary by country and regulatory body. Products are certified to Indian food safety standards unless otherwise stated;
  • Boxkart does not independently test products for food safety compliance and relies on supplier-provided certifications and documentation;
  • Food-grade suitability may be affected by temperature, moisture, storage conditions, and the type of food being packaged. Customers are responsible for verifying suitability for their specific application;
  • Products should not be used in ways not intended by the manufacturer (e.g., microwaving packaging not rated for microwave use).

3.2 Allergen Disclaimer

Our packaging products are manufactured in facilities that may also process materials containing allergens. Boxkart makes no representations regarding allergen-free manufacturing. If allergen-free packaging is a requirement for your use case, please contact us at buy@boxkart.shop before purchasing to discuss your specific requirements.

3.3 Regulatory Compliance

It is the customer's sole responsibility to ensure that the products purchased comply with all applicable laws, regulations, and standards for their intended use, including but not limited to FSSAI regulations, BIS standards, and any applicable state-level food safety requirements.

4. Sustainability & Environmental Claims Disclaimer

4.1 Scope of Environmental Claims

Certain products in our catalogue may be described using terms such as “compostable”, “biodegradable”, “eco-friendly”, “recyclable”, or “sustainable”. These claims are made in good faith based on information provided by our suppliers and, where applicable, supported by third-party certifications. However, customers should be aware of the following important limitations:

4.2 Compostable Products

  • Products described as “compostable” may be certified to industrial composting standards (e.g., IS 17088, EN 13432, or ASTM D6400) and may not break down effectively in home composting environments or landfill conditions;
  • Industrial composting requires specific temperature, humidity, and microbial conditions that are not replicated in standard home compost bins or landfills;
  • Compostable products should be disposed of through certified industrial composting facilities where available. Boxkart does not guarantee the availability of such facilities in your area;
  • If compostable products end up in landfill, they may not degrade significantly faster than conventional plastics.

4.3 Biodegradable Products

  • The term “biodegradable” does not imply that a product will break down quickly or completely in all environments. Degradation rates depend heavily on environmental conditions including temperature, moisture, oxygen levels, and microbial activity;
  • Boxkart does not make representations about the specific timeframe within which any product will biodegrade;
  • Products described as biodegradable should still be disposed of responsibly and in accordance with local waste management guidelines.

4.4 Recyclable Products

  • Products described as “recyclable” are made from materials that are technically capable of being recycled. However, actual recyclability depends on the availability of recycling infrastructure in your area;
  • Products contaminated with food residue may not be accepted by recycling facilities. Customers are advised to clean packaging before recycling where possible;
  • Boxkart does not guarantee that recyclable products will be accepted by your local recycling programme.

4.5 Certifications

Where products carry specific environmental certifications, these are based on certifications held by the manufacturer at the time of listing. Boxkart does not independently verify or maintain these certifications. Certification status may change without notice if the manufacturer's certification lapses or is revoked. Customers requiring current certification documentation should contact us at buy@boxkart.shop before purchasing.

4.6 Anti-Greenwashing Statement

Boxkart is committed to honest and accurate environmental marketing. We do not make environmental claims that we cannot substantiate. If you believe any product listing contains an inaccurate or misleading environmental claim, please contact us at support@boxkart.shop and we will investigate and correct the listing promptly.

5. Customised & Logo-Printed Products Disclaimer

For customised or logo-printed products:

  • Boxkart is not responsible for poor print quality resulting from low-resolution or low-quality artwork submitted by the customer;
  • Colour accuracy of printed output may vary from digital proofs due to printing process limitations and material surface characteristics;
  • The customer is solely responsible for ensuring that all artwork, logos, and text submitted for printing do not infringe any third-party intellectual property rights. Boxkart accepts no liability for intellectual property infringement arising from customer-supplied artwork;
  • Customised products are non-returnable and non-refundable except in cases of manufacturing defects or incorrect items delivered, subject to our Refund Policy.

6. Warranty Disclaimer

To the fullest extent permitted by applicable law:

  • Boxkart provides products on an “as is” and “as available” basis;
  • Boxkart expressly disclaims all implied warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement;
  • No warranty is made that products will meet your specific requirements beyond their stated intended use;
  • No employee, agent, or representative of Boxkart is authorised to make any warranty on behalf of Boxkart beyond what is expressly stated in these disclaimers or on the relevant product listing page.

Nothing in these disclaimers shall limit or exclude any liability that cannot be excluded under applicable Indian consumer protection law, including the Consumer Protection Act, 2019.

7. Limitation of Liability

To the maximum extent permitted by law, Boxkart's total liability to any customer in connection with any product shall not exceed the purchase price paid for that specific product, excluding shipping charges and GST. Boxkart shall not be liable for:

  • Any indirect, consequential, incidental, special, or punitive damages;
  • Loss of profits, revenue, business, or goodwill;
  • Damage to property caused by the use or misuse of our products;
  • Personal injury arising from misuse of products or use contrary to their intended purpose;
  • Any claims arising from the customer's failure to comply with applicable food safety or environmental regulations.

8. Indemnification

By purchasing from Boxkart, you agree to indemnify, defend, and hold harmless Boxkart, its directors, employees, agents, and suppliers from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your misuse of our products;
  • Your violation of any applicable law or regulation in connection with the use of our products;
  • Any intellectual property infringement arising from artwork or content you have supplied to Boxkart for customisation;
  • Any third-party claims arising from your use of our products in your business operations.

9. Governing Law

These disclaimers and any disputes arising from them are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of India.

10. Updates to This Page

Boxkart reserves the right to update these disclaimers at any time. Changes will be reflected on this page with a revised “Last updated” date. Continued use of our website and purchase of our products after any changes constitutes acceptance of the updated disclaimers.
